DAB Decision No. 2109: Babyland Family Services
 

Babyland Family Services appealed the decision of the Administration for Children and Families to terminate their Early Head Start Program grant. A decision by Appellate Division required Babyland to correct deficiencies within 30 days of the initial review report regardless of whether the grantee prepared a corrective action plan. Grantees may prevent similar action by reading this decision.

DECISION

By letter dated November 7, 2006, Babyland Family Services, Inc. (Babyland) appealed the decision of the Administration for Children and Families (ACF) to terminate Babyland's Early Head Start Program (EHSP) grant. ACF relied on Babyland's "failure to correct all deficiencies within the time period specified in prior written notice." ACF letter to Babyland at 1 (Oct. 5, 2006) (ACF termination notice). Babyland argued that it submitted a corrective action plan, which ACF did not reject, and that all the cited deficiencies were corrected before Babyland received the termination notice. Babyland also alleged that all of the deficiencies cited in the termination letter were included in the corrective action plan and corrected before the date of the termination letter. Babyland therefore asked that the termination be dismissed as premature and, in the alternative, for a hearing. Full text» [PDF, 117KB]
