45 CFR 1308.16 Eligibility Criteria: Traumatic Brain Injury
 
Abstract

A child is identified with traumatic brain injury when a brain injury caused by external force or internal occurrence (e.g., stroke) serves as a barrier to educational performance. This standard provides parents, administrators, staff, and related service providers with the Federal definition and includes some guidance in forming evaluation teams and providing other related services.

Subpart D_Health Services Performance Standards

Sec. 1308.16 Eligibility criteria: Traumatic brain injury.


A child is classified as having traumatic brain injury whose brain injuries are caused by an external physical force, or by an internal occurrence such as stroke or aneurysm, with resulting impairments that adversely affect educational performance. The term includes children with open or closed head injuries, but does not include children with brain injuries that are congenital or degenerative or caused by birth trauma.
